1.
Validity
Our General Terms and Conditions of Trading
encompass contractual clauses for all contracts
entered into with our customers. Differing terms,
if stated on behalf of the ordering Party, are
deemed invalid.
2. The
Contract
Your order is legally binding. It remains at our
discretion to accept your order, acceptance of
which will be within 1 month, either by
confirmation of receipt or delivery of the ordered
goods.
3. Withdrawal of
order
You have a 1 month period of notice to withdraw
your order:
a. You are
not obliged to accept the ordered goods if you
withdraw from the contract within two weeks of
delivery of the goods. The period of notice starts
on the day the goods are delivered.
b. Your
withdrawal from the contract does not need to be
explained but must be in writing or return of the
goods to Classic Ship Collection GmbH,
Strandweg 5, 23570 Lübeck-Travemünde.
Your written withdrawal of return of the goods must
be within the period of notice.
c. Should
you decide to withdraw from the contract, you are
obliged to return the goods to us at your expense.
We will then return any monies paid for the
goods.
d. Exclusion
from withdrawal of contract:
Articles that have
been especially designed to meet your
specifications or personal requirements, or which,
due to their composition are unsuited for return,
are excluded from the right of withdrawal of
contract.
Please return the
goods in their original condition and packaging,
also remembering to enclose the invoice.
4. Price/Change
of Product and non-delivery
All prices stated refer to the prices in our latest
catalogue. We reserve the right reject orders, as
well as the right of non-delivery, should the
ordered articles not be available. In this case we
will inform you immediately and return any payments
made.
5. Payment and
delivery
In FRG we deliver against invoice or payment by
credit card (mail order). We also deliver free of
postage all goods ordered within the FRG valued at
more than Euro 100,00. In special cases, we reserve
the right to insist upon advance payment or cash on
delivery.
Orders from abroad
can only be accepted against advance payment or
credit-card (VISA or Master/Eurocard). Foreign
orders will be charged at the cheapest possible
tariff that the German Post charges for Premium
packages.
6.
Propriety
The delivered goods remain our sole property until
full payment has been effected, regardless of the
period of notice.
7. Defective
goods
Should any of the delivered goods reach you in a
defective or faulty condition, we will do our
utmost to rectify the situation as specified by
law. In this case we ask you to contact us
immediately or to return the defective or faulty
goods to us, if possible carefully packed in the
original packaging, postage paid to our above
mentioned address, stating the cause of rejection.
To prove the validity of your claim, we ask you to
also enclose the original invoice. Please also
retain your postal receipt as proof that you have
returned the goods to us (in case of loss in the
post).
8.
Confidentiality
Your personal details are regarded by us as
strictly confidential and are subject to the data
protection act as stated by law. You will only
receive information from other companies if you
have authorised us to release your details to
them.
9.
Legality
These Terms and Conditions of Trading are subject
to German Law
